Terms and Conditions

Eligibility: You must be at least 18 (or age of majority) to use the Services. If you use the Services for an organization, you represent you have authority to bind that entity.

Account Registration: Provide accurate, current info; keep it updated. You are responsible for safeguarding credentials and account activity. Notify support@builtbyrose.co of any unauthorized use.

Acceptable Use: No unlawful activity; no spam/phishing/malware; no unauthorized access or interference; no reverse engineering except where legally permitted; no training competing services on our content/AI outputs; no harassment/rights violations. We may suspend/terminate for violations.

Ownership: All content (text, media, guides, playbooks, prompts, templates, software, AI outputs) is owned by E.M. Rose Group LLC or licensors. Rights not granted are reserved.

License: Limited, non-exclusive, non-transferable license for personal/internal business use. No resale, publication, or distribution outside your organization without consent.

User Input and AI Outputs: You own your input. You grant us a license to use it to operate/improve the Service. AI outputs include our proprietary content; you may use them internally under the same restrictions and at your own risk.

Feedback: Provided ideas/suggestions may be used by us royalty-free, perpetually, and with sublicensing rights.

Knowledge products include free and paid items; subscriptions follow the Subscription Terms and Money-Back Guarantee (incorporated by reference).

Pricing (current plans): 1-Week $12.99 (weekly renewal), 1-Month $39.99 (monthly renewal), 3-Month $69.99 (quarterly renewal). Prices/plan structure may change with notice before next billing.

Billing/Payment: Authorize initial and recurring charges to your payment method; keep billing info current. Fees in USD; taxes may apply. Payments processed securely via third parties (e.g., Stripe).

Automatic Renewal: Subscriptions renew per interval until canceled.

Cancellation: Cancel anytime via account or support@builtbyrose.co; access continues through the paid term; no pro-rata refunds unless required by law or Money-Back Guarantee applies.

Promotions/Discounts: Typically apply only to first term unless stated; renew at standard rate afterward; eligibility at our discretion; generally one promotion per subscription.

Refunds: Digital products/subscriptions generally non-refundable; Money-Back Guarantee may apply if criteria met; legal rights remain intact.

Use of Services is subject to our Privacy Policy. We use cookies/analytics (e.g., Google Analytics, GTM, PostHog, Meta/TikTok/Reddit pixels). If you disagree with data practices, discontinue use.

By You: Stop using anytime; delete account or cancel subscriptions. Uninstalling without canceling may leave subscriptions active and billable.

By Us: We may suspend/terminate for policy or legal violations, abuse, security issues, or discontinuation of Services.

Effect: Access to paid features ends; data may be deactivated/deleted per Privacy Policy. No refund for breach-related terminations.

Services are provided “as is” and “as available.” No warranties (express, implied, statutory), including merchantability, fitness, title, non-infringement. No guarantee of uninterrupted or error-free operation.

AI outputs may be incorrect or misleading; evaluate before reliance. No professional advice is provided; consult qualified professionals for decisions.

To the maximum extent permitted, we are not liable for indirect, incidental, special, consequential, punitive damages, or lost profits/revenues/data/goodwill, arising from use or inability to use the Services, third-party conduct/content, reliance on content/AI outputs, or unauthorized access.

Cap: Total liability is limited to amounts paid by you for the Service in the three (3) months preceding the claim; if you paid nothing, liability is zero.

Some jurisdictions restrict limitations; where applicable, limits apply to the fullest extent permitted.

You will indemnify E.M. Rose Group LLC and affiliates against third-party claims arising from your use, violations of Terms/law, or infringement of others’ rights. We may assume defense at your expense; no settlement without our written consent.

Services may change (features added/removed/modified) or be discontinued; we’ll attempt advance notice for significant impacts.

Terms may be updated; “Last Updated” will change. Material changes may include notice (site/email). Continued use after effective date = acceptance. If you disagree, stop using/cancel.

Governing law: Delaware, USA (conflict rules excluded). Consumer protections in your locale may still apply if mandatory.

Jurisdiction/Venue: Exclusive courts in Delaware, USA, except for equitable/injunctive relief to protect IP. International consumers retain any mandatory local rights.

Entire Agreement: These Terms + Privacy Policy + Subscription Terms + referenced policies.

No Waiver unless in writing; Severability applies; Headings are for convenience only.

Assignment: You may not assign without consent; we may assign (e.g., merger/acquisition).

Third-Party Links: Use at your own risk; governed by third-party terms/policies.
